Terms of Service

Last updated 1 November 2026

These terms are the agreement between your business (“you”) and AVOLIA S.R.L. (“we”, “us”), the company that runs Churnahead (the “Service”). You accept them by ticking the box on the sign-in page or by using the Service. If you accept for a company, you confirm that you can bind it.

The Privacy Policy, the Data Processing Agreement and the Acceptable Use Policy are part of these terms.

1. Who can use Churnahead

Churnahead is for businesses. You must use it for your trade, business or profession, not as a consumer, and you must be at least 18. You may connect only Stripe accounts that you own or are authorised to connect.

2. What the Service does

Churnahead reads your Stripe account with read-only access, keeps a copy of the records it needs, scores each customer for the risk that they cancel, and sends you a digest and alerts by email or Slack. It also replays its rules over your past churn (the backtest), reports on revenue, and can draft a message for you to send to a customer.

Scores, forecasts, backtests and drafts are estimates based on billing data. They are not guarantees and not professional advice. What you do about a customer, and what you say to them, is your decision.

The Service never writes to your Stripe account and never contacts your customers.

3. Your account

You sign in with a link sent to your email. Keep that mailbox secure: anyone who can open the link can open your workspace. You are responsible for what happens in your workspace and for keeping the email address on it current. Tell us at hello@churnahead.com if you think someone else has accessed it.

4. Your data

Customer Data is everything the Service receives from your Stripe account or from you, including your customers’ names, email addresses, subscriptions, invoices and payments, and the notes, settings and example emails you add.

  • You own your Customer Data. You give us the right to host, copy, process and display it only to provide, secure and support the Service for you.
  • You confirm that you have the rights, notices and legal basis needed to share Customer Data with us, including any personal data of your customers.
  • We process personal data in Customer Data as your processor under the Data Processing Agreement.
  • You can delete your Customer Data at any time with the delete button on the Connect page. We don’t sell Customer Data and don’t use it to train AI models.

We may use aggregated and anonymised information about how the Service is used, which identifies neither you nor your customers, to run and improve the Service.

5. Plans, fees and payment

  • Free plan. Free for up to 25 paying customers, with a weekly digest. We may change or end the free plan with 30 days’ notice.
  • Paid plans. Fees are shown on the pricing page and in the dashboard, in US dollars, per workspace per month, and are charged in advance through Stripe. A subscription renews each month until you cancel it.
  • Taxes. Prices don’t include VAT or other taxes. We add them where the law requires. For B2B customers in the EU outside Romania, VAT may be reverse-charged when you give us a valid VAT number.
  • Cancelling. You can cancel at any time from the Billing page. The paid plan runs until the end of the period you paid for, and then the workspace moves to the free plan. Fees already paid aren’t refunded, except where the law requires it.
  • Over the limit. A workspace with more paying customers than its plan covers keeps working, moves to the weekly digest, and shows an upgrade notice.
  • Price changes. We’ll tell you at least 30 days before a price change applies to you. It applies from your next renewal after that.
  • Unpaid fees. If a payment fails and isn’t fixed within 14 days, we may move the workspace to the free plan.

6. Acceptable use

You’ll use the Service lawfully and in line with the Acceptable Use Policy. In particular, you’re responsible for any message you send to a customer, including one that started as a Churnahead draft. It must comply with the laws on privacy and electronic marketing that apply to you.

7. Other services

The Service connects to services that we don’t run, such as Stripe and Slack. Your use of them is governed by their terms. We aren’t responsible for them, and a change on their side can affect what the Service can do.

8. Availability, support and changes

We work to keep the Service available and secure, but we don’t promise that it will be uninterrupted or error-free. There is no service-level agreement unless we sign one with you. Support is by email at hello@churnahead.com. We may add, change or remove features. If a change materially reduces what a paid plan includes, we’ll tell you in advance, and you can cancel.

9. Our property

We own the Service, its software, design and content. These terms give you a non-exclusive, non-transferable right to use the Service while your account is active. You don’t get any other rights. If you send us feedback, we may use it without any obligation to you.

10. Confidentiality

Each of us will keep the other’s non-public information confidential and use it only for this agreement. This doesn’t cover information that becomes public through no fault of the receiving party, that it already had, or that it must disclose by law.

11. Suspension and termination

You can stop using the Service at any time. To close your account, delete your data from the Connect page and email us to remove the workspace and your sign-in.

We may suspend or close a workspace if you seriously or repeatedly breach these terms, if your use puts the Service or others at risk, or if the law requires it. Where it’s reasonable, we’ll warn you first and give you a chance to fix the problem.

When an account closes, we delete its Customer Data within 30 days. Records we must keep by law, such as invoices, are kept for as long as the law requires.

12. Disclaimer

Except as these terms say, the Service is provided “as is”. To the extent the law allows, we make no other warranties, such as fitness for a particular purpose, or that a score or forecast will be accurate or that any customer will be kept.

13. Limitation of liability

To the extent the law allows:

  • Neither of us is liable for indirect or consequential loss, or for lost profits, revenue, customers or goodwill.
  • Each party’s total liability under these terms is limited to the greater of the fees you paid us in the 12 months before the claim and EUR 100.

These limits don’t apply to liability that the law doesn’t allow to be limited, including liability for intent or gross negligence, or to your obligation to pay fees.

14. Indemnity

You’ll defend and compensate us against claims by third parties that arise from Customer Data you had no right to share, or from your breach of the Acceptable Use Policy, including messages you sent to your customers.

15. Changes to these terms

We may update these terms. For a material change, we’ll tell you by email or in the dashboard at least 30 days before it takes effect, and you’ll be asked to accept the new version the next time you sign in. If you don’t agree, you can stop using the Service and cancel before the change applies. Each version shows the date it took effect.

16. Governing law and disputes

Romanian law governs these terms. Any dispute goes to the competent courts of Bucharest, Romania. Mandatory rights you have under the law of your own country aren’t affected.

17. General

These terms are the whole agreement between us about the Service and replace any earlier ones. Neither of us may transfer it without the other’s consent, except to a company that acquires our business or yours. If part of these terms can’t be enforced, the rest still applies. A delay in enforcing a right isn’t a waiver. Notices to us go to hello@churnahead.com. Notices to you go to the email on your workspace. These terms are written in English, and the English version prevails.
